I. GENERAL INFORMATION:

  1. The online shop Fakkels.com is owned by SYTP SPZOO, based in Białystok, Poland – hereinafter referred to as the shop.

  2. A person or company that has placed an order online or by telephone is referred to below as a customer.
  3. The shop reserves the right to amend these terms and conditions. The terms and conditions come into effect from the moment they are published on the shop’s website.
  4. The shop is obliged to keep the information we receive from our customers confidential. We use the information you provide for purposes such as processing orders, responding to customer enquiries and communicating with you. We do not voluntarily share our customers’ information with third parties.
  5. The shop reserves the right to remove products from its range and/or change their prices without giving any reason.
  6. The shop reserves the right to refuse to process an order if there are grounds for suspicion, for example if an email address and/or telephone number is missing and it is therefore impossible to confirm the order. The same applies if the customer’s details are incomplete.
  7. The prices of all products listed in the shop are shown in euros and are final prices. This means that these are gross prices, inclusive of all taxes (e.g. VAT – value added tax). The customer will not be charged any additional costs or receive any further invoices.
  8. Customers who wish to receive an invoice are entitled to ask the shop to issue an invoice for the products purchased without the customer’s signature.
  9. For B2C customers, invoices are issued automatically provided their name and tax identification number (e.g. NIP in Poland) are provided at the time of ordering. It is not possible to receive a B2C invoice after the order has been delivered.

II. PURCHASE ORDER:

  1. To place an order with the shop, the customer confirms that they are of legal age; over 18 years of age.
  2. By placing an order, the customer declares and agrees that none of the products purchased will be used in an illegal or irresponsible manner. Furthermore, the customer declares that they will not breach any laws in their own country and/or other countries.
  3. A transaction is completed as soon as the customer has added the products to their shopping basket and confirmed the order. Placing the order is deemed to constitute acceptance of the shop’s terms and conditions.
  4. Customers can place orders in the online shop 24 hours a day, 7 days a week, all year round. The shop accepts all orders, but orders are dispatched on working days.
  5. As these products are of a pyrotechnic nature, it is impossible to test them before they are dispatched. Although all products are manufactured to the highest standards, there is a significant gap between production and use. Therefore, upon purchase, the customer acknowledges that they understand the product has not been tested and, as such, accepts full responsibility for the product’s successful operation.
  6. Once the customer has placed an order, they will receive confirmation by email or telephone. It is not possible to cancel an order that has already been confirmed.
  7. Orders are processed in the order in which they are placed and in the order in which final payment is received in the shop’s bank account.
  8. The final payment is calculated based on the prices of the products purchased, delivery charges or cash-on-delivery fees. The product prices displayed in the shop do not include delivery or cash-on-delivery charges, which are payable by the customer.
  9. If it transpires that items in the customer’s order are currently out of stock, we will contact the customer by email or telephone. At the same time, we will inform the customer of any delays in delivery resulting from the temporary unavailability of the ordered items.
  10. It is the customer’s responsibility to promote the positive atmosphere and ethos of the shop, and of the Say Yes To Pyro movement in particular. In the event of a breach, the customer agrees to pay an immediate fine of 1,000 euros imposed by the shop, and 500 euros for each day that the breach continues.
  11. The shop hereby prohibits anyone from placing an order with the intention of uncovering the shop’s internal operations and/or generating negative publicity for the shop and/or causing any form of negative issues for the shop. Upon purchase, the customer agrees to this condition and consents to an immediate fine of 2,000 euros imposed by the shop and 1,000 euros for each day that the breach continues and/or the consequences of the breach are felt by the shop.

III. SHIPPING & DELIVERY:

  1. The shop recognises the importance of protecting the products the customer has ordered during dispatch. That is why we ensure they are properly packaged, so that the items are delivered in perfect condition.
  2. If you choose to pay on delivery, you are required to pay for the products upon delivery.
  3. All orders are dispatched via the best courier services. The shop wishes to clarify that all products purchased are legal in all EU countries and that the parcel you receive will be dispatched in accordance with all international regulations and company policies established by the courier service.

IV. COMPLAINTS AND RETURNS:

  2. The customer must unpack the delivery in the presence of a representative from the shipping company. If any mechanical damage to the products (caused by transport) is noted, draw up a report signed by both the customer and a representative from the shipping company. Only with such a report will the shop accept the customer’s complaint regarding damage to the products that occurred during shipping. Otherwise, you should submit the complaint to the shipping company rather than to the shop.
  3. Due to the nature of the product and the fact that each item is made to order, returns are not accepted.
  4. Customers are guaranteed that their products will be exchanged or their money refunded (up to the price of the product) should their complaint be deemed valid and the damage have arisen as a result of the Shop’s malfunction.
  5. Once the Customer’s complaint has been accepted, the money will be credited to the Customer’s account or refunded within a maximum of 14 working days. The Customer is responsible for the packaging and postage costs for returned products.
  6. The shop does not accept returns sent in padded envelopes.
  7. Complaints relating to poor product packaging, leaks, tears, etc. will only be accepted provided that Customers have collected their delivery no later than one day after arrival.
